SC dismisses petition seeking grant of permanent commission to women army officers

New Delhi: SC dismisses plea by women officers who completed 14 years in service after cut off date for the extension of commission, stating that the Army Women should be given permanent commission in all the ten streams irrespective of their service.

The Bench of Justice DY Chandrachud, Justice KM Joseph and Justice Indu Malhotra said that "There will be serious implications of relief and other benefits for a batch of officers who have completed 14 years in March 2020 to take advantage of the permanent commission. The top court said that each batch must have completed 14 years. According to our decision, those who have completed 14 years of service as on the date of the verdict of the apex court, will get the benefit of pension and permanent commission. It's difficult to address these matters because they are all in service of the nation. We feel that we should be able to do something for them but where do we draw the line"

During the hearing, the counsel, appearing for the women army officers, argued that the judgment of the Supreme Court came on February 17 while the women officers who filed the petition have completed 14 years in March. They should get the benefit because the government started implementing the orders in July.
