Freedom Of Press Can’t Be One-Way Traffic, Says Supreme Court

NEW DELHI: After the Modi government era in the country, many journalists and media institutions had questioned the freedom and fairness of journalism. On a case relating to media freedom, the Apex Court has made a big point. Hearing a petition filed by a news portal called The Wire, the court said that press freedom is supreme but it cannot be like oneway traffic. Yellow journalism should not find any place.

In fact, The Wire had moved the apex court against the Gujarat High Court's order to prosecute Jay Shah, son of the country's Home Minister Amit Shah, who was pending for nearly a year and a half. The Supreme Court allowed the news portal to withdraw the petition. Jai Shah had filed a contempt petition against an article written in The Wire. The Supreme Court also directed the trial court to complete the contempt case against the news portal at the earliest.

A bench headed by Justice Arun Mishra, on behalf of The Wire, senior counsel, and Congress leader Kapil Sibal sought withdrawal of the petition. He said his plaintiffs wanted to face trial in a Gujarat court. During the hearing, the bench expressed deep displeasure over the current trend of journalism in the country, which has affected the judiciary in the recent past.

The bench said, it has become a fashion to issue a notice to anyone seeking their reply and any article should be published within 5-6 hours before responding to it. The Bench said, "We have suffered a lot. What kind of journalism is this? It is a serious issue. Why should we not take suo motu cognizance of this issue? We are very much concerned as a judge of this court. The bench said that the matter will be considered at an appropriate time. The case had caught a lot of fuss. The opposition had launched a scathing attack on PM Modi and Shah on the pretext of the case.
