New Delhi: The Supreme Court has refused to entertain a petition filed by senior Bengal BJP leader Subhendu Adhikari. The petition had challenged the decision of West Bengal Assembly Speaker Biman Banerjee not to disqualify TMC MLA Mukul Roy under the anti-defection law. 

Earlier, West Bengal Assembly Speaker Viman Banerjee had turned down the petition of the leader of the opposition in the assembly, Subhendu Adhikari. In which he had requested to disqualify Mukul Roy as an MLA under the anti-defection law to change the party after the elections. Former BJP national vice-president Mukul Roy had joined the ruling Trinamool Congress (TMC) in June last year.

An official of the Assembly Secretariat said that the hearing of the case was completed last month. Viman Banerjee said the petitioner could not produce the required quality evidence. Under the facts and circumstances of the case and under the law, I found that the petitioner was not able to prove the arguments mentioned in the petition, so I dismissed the petition. According to sources in the Assembly Secretariat, Roy will continue as an MLA in the House in view of the law.
