New Delhi: The Supreme Court on Wednesday refused to list a petition against former BJP spokesperson Nupur Sharma for urgent hearing. The petition sought a direction from the apex court to authorities to take action and arrest Nupur Sharma for his alleged remarks against Prophet Mohammad and hurting sentiments of the Muslim community.
A vacation bench of Justices Indira Banerjee and JK Maheshwari referred advocate Abu Sohel, who sought an urgent hearing of the case, to the Registrar. The council had sought an urgent hearing of the case, saying that no action has been taken against Nupur Sharma by the police even after the complaint. On the petition, the court said, "Why mention the matter before the vacation bench? First, list the case with the Registrar.'' Lawyer Abu Sohail later said that he has taken up the matter with the registrar and it is expected to come up for a hearing on July 11. The plea said that Sharma had made derogatory remarks against Prophet Mohammed and the Muslim community. Therefore, directions may be given for a free, credible and impartial investigation into the case, so as to ensure immediate arrest.
The petition also said that Nupur Sharma's statement is violative of Articles 14, 15, 21, 26 and 29 of the Constitution and other fundamental rights. Lawyer Abu Sohail said that Nupur Sharma's words have created unrest in the country and the world and have created a ruckus, due to which the image of our country has been tarnished.
