SC rejects plea of Vijay Mallya's UBHL against High Court order to wind up the firm

New Delhi: The country's largest court on Monday dismissed a plea filed by fugitive liquor baron Vijay Mallya's company United Breweries Holdings Limited (UHBL). In the petition, the company had challenged the Karnataka High Court's order to close the UHBL to recover the dues of Kingfisher Airlines.

Justice U.U. A bench of Lalit, Vineet Saran and S Ravindra Bhat refused to consider the UHBLl's plea challenging the March 6 order of the High Court. A section bench of the Karnataka High Court upheld the order passed by the single judge's court in March on February 7, 2017. Senior advocate Mukul Rohatgi, on behalf of a group of State Bank of India-led banks, apprised the court that a backlog of Rs 3,600 crore has been levied, but UHBL and Mallya still owe Rs 11,000 crore.

Senior lawyer Mukul Rohatgi told the court that the Enforcement Directorate (ED) should not attach the assets of the company as these assets are mortgaged with the bank and the first right to claim is with the bank. Senior counsel from UHBL, C.S. Vidyanathan said that the total assets of the company are more than its total debt, so it does not become a matter of whether to direct the company to close.
