New Delhi: The Supreme Court has reprimanded the Central Government for depriving hate speech, saying that no action is being taken against hate speeches. A bench of Chief Justice (CJI) UU Lalit and Justice S Ravindra Bhat, while hearing a petition, said that no action is being taken on the need for an immediate ban on hate speech by the government.
The court said that the atmosphere is deteriorating due to hate speech, but no action is being taken on it. This needs to be curbed. Petitioner Harpreet Mansukhani, appearing in person in the court, said that hate language was used to make a statement about making India a Hindu nation before the 2024 Lok Sabha elections. He said that nowadays abusive language has become like a business to get benefits. In his arguments, the petitioner said that Kashmir Files, a film made on the gruesome massacre of Kashmiri Hindus, should be made tax-free. The petitioner alleged that he had referred to statements by senior BJP leaders that minorities were killed.
At the same time, CJI UU Lalit said during the hearing that normal criminal proceedings need to be taken in such cases. For this, we have to see who is involved and who is not. At the same time, the petitioner said that giving hate speech is part of a kind of conspiracy, some guidelines are needed to stop it. The petitioner said hate speech is like an arrow which, once left out of command, cannot be withdrawn. At the same time, CJI Lalit has said that 'The court needs a factual background to take cognizance in such cases. We need some examples. Otherwise, it is like a random petition.' To this, the petitioner, on his part, said an affidavit would be filed on his behalf citing instances of hate speeches in which criminal cases were not registered.
