New Delhi: The Supreme Court of the country is now considering whether sub-categories can be created in these groups to extend the benefit of reservation within SC / ST / OBC to the needy. It is the wish of the apex court that the benefit of reservation of Scheduled Castes, Scheduled Tribes and Backward Classes should be given to those people of this group who are still very much backward.

The Supreme Court of the country has decided to set up a constitutional bench of 7 judges to consider the issue. This bench will brainstorm on whether another subcategory should be created within the SC, ST and OBC reservation list so that its benefits can be extended to the most backward people of these three groups. During the hearing on this matter, on Thursday, the court said that if the state government had the power to give reservations, then it also has the right to sub-classification and such sub-classification is reserved for reservation. Tampering with can not be considered equal.

Earlier, a bench of 5 judges had said that sub-classification cannot be done. But today the bench of five judges said that the sub-classification is legal. The 5-judge bench of the top court has said that the state assembly can legislate to provide special facilities to certain special castes within the scheduled caste group.
