Triple Talaq: SC has no right to interfere in Shariat laws says AIMPLB

Aurangabad (Maharashtra) [India] Jan 10 (NT): The All India Muslim Personal Law Board (AIMPLB) on Tuesday raised questions over the approach of Supreme Court in the triple talaq subject and asserted the court does not have the right to 'make' the law.

Maulana Ata Ur Rehman Rashdi, member of the board AIMPLB, said the job of the Supreme Court is to pronounce decisions within the compass of law and not to 'make' the law.

"This very role of the court is a violation of basic rights which can never be accepted. The interference of the apex court and the government in the Shariat laws is also wrong," Maulana quoted.

For now, the Muslim Women (Protection of Rights on Marriage) Bill, 2017 tries to find to criminalize instant triple talaq.

The draft of the bill was passed in the Lok Sabha with most of the leading political parties in the Opposition, together with the Congress, voting in favor, but with limitations.

The bill, if puts in practice will make triple talaq a criminal offense. It proposes a three-year imprison for a Muslim man who dissociates his wife in any form of spoken, written or by electronic means such as email, SMS, and WhatsApp. (NT)
