25-week pregnant rape victim can get abortion, Delhi HC's big verdict

New Delhi: The Delhi High Court has allowed a minor rape victim to terminate her pregnancy of about 25 weeks. The court has said that if she is forced to bear the burden of motherhood at an early age, her suffering will increase further. At the same time, the High Court has directed the medical board of Safdarjung Hospital to complete the process in this regard.
  
Justice Yashwant Verma said that forcing the petitioner to undergo pregnancy would completely shake her soul and cause serious and irreparable damage to her mental health. He further said that the court cannot imagine her right to life being further hurt and if she is forced to perform the difficult duties of motherhood, she will have to go through mental and physical trauma and it is unimaginable.
    
The high court accepted the petitioner's plea to terminate the pregnancy and directed the concerned hospital to preserve the foetus for DNA testing, which would be required in a criminal case related to the incident. The medical board, in its report of July 16, had said that the petitioner's age was around 13 years and the duration of pregnancy was 25 weeks and six days and had said that in pregnancy of more than 24 weeks, the law allows abortion only in case of foetal abnormalities.
