SC scowls over Delhi HC's decision to hear Navlakha's bail plea

The Supreme Court of India has expressed its displeasure at the Delhi High Court considering Gautam Navlakha's bail plea. Especially when the apex court has rejected Navlakha's similar plea and asked him to surrender on time. In January 2018, Navlakha was arrested by Pune Police from his residence in Delhi in August 2018 in connection with the violence in Bhima Koregaon case in Pune district. However, the Delhi High Court set aside the order for transit remand.

Justice Arun Mishra of the Supreme Court and the bench of Abdul Nazir said that the interim order given by the Supreme Court on June 2 in this regard will remain in force. The apex court had stayed the May 27 decision of the High Court. In this decision, the High Court had pulled up the NIA for showing haste in taking Navlakha from Delhi's Tihar Jail to Mumbai. During the hearing, Additional Solicitor General Aman Lekhi, appearing on behalf of the NIA, said that seeking records from a lower court does not come under the jurisdiction of Delhi High Court.

Additional Solicitor General Aman Lekhi also said that the NIA has not shown haste to take Navlakha to Mumbai as the trial court had issued a warrant in this regard. The bench said, "When we rejected Navlakha's bail plea on an equal basis and asked him to surrender, what right does the Delhi High Court have to hear his bail plea." While ordering a copy of the petition to be provided to Navlakha, the bench said that the next hearing of the case will be held in July. Also said that interim orders will be effective till the next order.
