BSP MLAs merge with Congress, SC gives notice to speaker and 6 MLA

New Delhi: In the case of cancellation of membership of 6 MLAs of Bahujan Samaj Party (BSP) in Rajasthan, the top court has made important remarks. During the hearing, the court asked BSP counsel Satish Mishra why did you not challenge the order of the single-judge bench of the High Court in front of the Division Bench? Why did you come straight here? The top court has also sent a notice to the speaker of Rajasthan assembly and 6 MLAs who won on BSP ticket.

Earlier the Rajasthan High Court in its order had asked the assembly speaker to decide on the disqualification petition filed against the 'merger' of the 6 BSP MLAs. The BSP argues that it is a national political party. The state unit cannot decide the merger with any other party. According to the party constitution, only the national unit can decide the merger of the party.

6 MLAs were won on the BSP ticket in Rajasthan Assembly 2018 election. But later all of them joined the Congress party. After some time these MLAs applied for a merger with the Congress and the assembly speaker gave orders in this regard. Challenging this merger, BJP leader Madan Dilavar had said that the merger of these 6 MLAs into Congress is unconstitutional. In this case, a hearing is going on in the court on this issue.
