Criminalization of Politics might ruin everything: Supreme Court

Terming the criminalization of politics as a rot, the Supreme Court said that it is considering the directive to the Election Commission to highlight the criminal record of its members with political parties. So that the voters could know how many imps were filled in such parties. 

The Constitution Bench of five judges, headed by Chief Justice Deepak Mishra, on Tuesday, responded by speaking to the Central Government. The Center had said that considering the concept of power or division of the workplace, the issue of MPs being disqualified in the Parliament could arise.

Justice RF Nariman, AM Khanwilkar, DC Chandrachud and Indu Malhotra, who were included in the Bench, said that the executive thinks of the concept of sharing power between the legislature and the judiciary all. The said that they cannot direct the Parliament to make laws. The question is what can we do to stop this rot.

The bench, hearing the petition filed in connection with the prevention of criminal cases of serious criminal cases against electoral politics, took the cognizance of the suggestions of senior advocate Krishnan Venugopal. In this case, he is the lawyer of BJP leader Ashwini Upadhyay.

A public interest petition of Upadhyaya states that the court can ask the Election Commission to direct the political parties not to give tickets with any criminal cases. Or do not support an independent candidate with serious criminal charges.

The Bench said that criminalization of politics is anti-democracy. The Constituent Assembly said that we can direct the Election Commission to give details of its criminal cases by giving an affidavit to all its members and future members. These affidavits should be made public so that the voters know how many miscreants are in a political party. Referring to not interfering in anybody's workplace, the Constitution Bench said that the party's election symbol can be deteriorated.
