Delhi HC allows 33-week pregnant woman to undergo abortion

New Delhi: The Delhi High Court has allowed a 33-week pregnant woman to undergo an abortion. The court gave this decision after hearing a report from the medical board and the arguments of expert doctors. The Delhi High Court on Tuesday allowed a 26-year-old woman to terminate her pregnancy, saying the final decision in cases of abortion should be taken keeping in mind the woman's choice of giving birth and the possibility of a dignified life of the unborn child.  

The woman had sought permission to terminate the fetus at the 33rd week due to some brain abnormalities in the fetus. Justice Pratibha M. Singh said a pregnant woman's right to terminate her pregnancy is becoming a subject of debate all over the world, adding that India recognizes a woman's choice in its laws. In the present case, the petitioner has sought permission to terminate the pregnancy after a brain disorder was detected in the fetus. The judge allowed the woman to have an immediate medical abortion, saying that unfortunately, the medical board did not give a clear opinion on the level of disability or the quality of life of the fetus after birth and that such uncertainty led to the demand for abortion. The order should be made in favor of the woman doing so.

To this, the High Court said that, ultimately, the High Court has come to the conclusion that the final decision in such cases should be made keeping in mind the choice of the woman to give birth and the possibility of a dignified life for the unborn child. This court allows medical abortion in this case.
