Delhi HC grants bail to 8 accused over Vandalism outside Kejriwal's residence

New Delhi: The Delhi High Court has granted bail to eight persons arrested by the Delhi Police in connection with a recent protest and vandalism outside the residence of Delhi Chief Minister Arvind Kejriwal.

"Since the nature of the evidence is such, there is no chance of the petitioners tampering with the evidence or enticing or frightening any witness," Justice Asha Menon's panel stated in pronouncing the ruling on Tuesday.

"When it comes to the harm done to public property, which cannot be neglected at any time, the facts must be reviewed in order to determine the extent of the damage. The protestors are accused of vandalising part of the CCTV cameras and one arm of a boom barrier, as well as smearing paint on the CM Residence's front gate. There is no accusation of damage to public property caused by arson, fire, or other means on a scale that would be substantially more serious than what has been alleged against the applicants. Except for three candidates who are older, the applicants are largely in their twenties "The court remarked.

The court went on to say, "The evidence collected thus far is of such a character that it cannot be tampered with by the applicants. Others who were identified in the images have been served with notifications under Section 41A of the Criminal Code and are cooperating with the investigation. As a result, the applicants' extended detention in jail is not justified only because some investigations are still ongoing."

"The court hence approves the bail applications and provides bail to all of the petitioners, who must each post a personal bond and a surety bond in the amount of Rs 35,000. The petitioners must notify the SHO if they plan to leave the NCT of Delhi "The court decision stated.
