The Delhi High Court declined to consider a plea aiming to remove Arvind Kejriwal from his role as chief minister following his arrest in a case related to the excise policy. Kejriwal was apprehended by the Enforcement Directorate (ED) over allegations of money laundering associated with the Delhi excise policy. The Rouse Avenue Court in Delhi had remanded the AAP leader to judicial custody until April 15. Kejriwal had been in ED custody for 10 days following a court directive.

The enforcement agency had earlier asserted Kejriwal's direct involvement in formulating the excise policy. According to report, "Arvind Kejriwal has also been intrinsically involved in the entire conspiracy of the Delhi liquor scam." Kejriwal's arrest marks the first instance in independent India where a sitting Chief Minister faces such charges. This action followed Kejriwal's repeated defiance of summons by the investigative agency, totaling nine, which he deemed "illegal."

The case revolves around alleged irregularities and money laundering linked to the framing and execution of the Delhi Excise Policy 2022, subsequently annulled. Although Kejriwal's name was absent in the initial FIRs filed by the ED or the Central Bureau of Investigation (CBI) regarding the Delhi excise policy, it emerged in the ED's chargesheet. The agency claimed Kejriwal had a video call with one of the main accused, Sameer Mahendru, directing him to continue working with co-accused and AAP communications-in-charge Vijay Nair.

Nair was among the first individuals arrested by the CBI in 2022. Following this, former Deputy Chief Minister Manish Sisodia and Rajya Sabha MP Sanjay Singh were also arrested in connection with the case.
