Mukesh has alleged that he was sexually abused in Tihar and was asked to have a physical relationship with Akshay, another accused in the Nirbhaya case. As soon as the case was started, Mukesh's lawyer Anjana Prakash said that the court can use judicial discretion to see if a proper decision has been taken in this case. Mukesh's lawyer gave before the court the example of Kehar Singh v. Government of India (1989) 1 SCC 204, saying that even the power of the President is open to human error.
