NEW DELHI: BJP leader Ashwini Upadhyay's demand to set a correct definition of minority in the country. On his demand, the Minority Commission says it is not within the jurisdiction of the Minority Commission to consider the demand. It falls under the jurisdiction of the Central Government to give whom minority status.

Petitioner Ashwini Upadhyay says that there are Hindu minorities in many regions, but they have not got any benefit for the minorities. The Commission has sent a written reply to the petitioner. In an application filed in the Supreme Court, Ashwini Upadhyay says that there are Hindu minorities in many states. Even after that, they do not get any benefit set for minorities. In 2017, the top court had asked Ashwini Upadhyay to appear before the Minority Commission. In response to his own memorandum, the Minority Commission has responded and sent a copy to Ashwini Upadhyay.

In his petition, Ashwani Upadhyay had demanded that Section 2(C) of the National Commission for Minorities Act should be dismissed as it is arbitrary, irrational and violates articles 14, 15 and 21. Under this section, the Central Government has unlimited and arbitrary powers to declare any community as a minority.
