KANPUR: A man from Kanpur has been sentenced to 10 years rigorous imprisonment and a fine of Rs 5,000 in a case of attempt to murder.

Rekha Singh, an additional session judge in Kanpur Nagar, delivered this judgment in favour of the defendant Surendra Kumar Upadhyaya.

Also, due to a lack of evidence, the court cleared Surendra Kumar of the allegations brought against him under sections 392/394/397/398 of the IPC.

A family conflict prompted the accused to shoot at one Rajendra Prasad. The medical professionals took the bullet out of his left shoulder.

Section 307 of the IPC was used to bring charges against the accused. The defence attorney pleaded that the accused should receive a minimum sentence because he had been imprisoned for the previous six years and eight months and was the only breadwinner in the family.

On the other hand, the prosecution wanted the maximum sentence because the accused had committed a serious crime.

The victim's father, Additional District Government Counsel (ADGC) Pradeep Bajpai, claims that in a complaint filed on August 6, 2012, at the Barra police station, he stated that his son, Rajendra Prasad Upadhyaya, was returning from the Jaunpur district when four motorcyclists, Arvind Upadhyaya, Surendra Upadhyaya, Nagendra Kumar, and Devendra Kumar Upadhyaya.

The accused was charged after the police opened a case and submitted a chargesheet.  The three co-accused had been found guilty in 2018, said the ADGC.

Due to Surendra Upadhyaya's disappearance, his file was divided, and the three co-accused were punished by the court in 2018. According to the ADGC, Surendra was later detained and his trial was held separately.
