MUMBAI: The Maharashtra government on Friday told the Bombay High Court that transgenders can apply for police constable posts and will frame rules setting standards for their physical test by February 2023. The Maharashtra Administrative Tribunal, while hearing a petition filed by two transgenders, had on November 14 directed the state government to make a third option for transgenders in addition to 'male' and 'female' in the application form for all recruitment under the home department.

A division bench of Bombay High Court Chief Justice Dipankar Datta and Justice Abhay Ahuja has taken this step regarding the delay in the state government's recruitment process rules for transgenders. On Friday, advocate Ashutosh Kumbhakoni told the bench that the government would modify its online website to include a third drop-down for transgenders in the category of 'gender' in the online application form.

He told the court that two posts of police constables would be kept vacant for transgenders. "The last date for everyone to submit the form has been extended till December 15. A third drop-down will be added by December 13," Kumbhakoni said. Let us tell you that the court was hearing a petition filed by the Maharashtra government against the order of the tribunal, in which it was directed to make provision for transgenders in the application form for posts under the Home Department. In its order, the bench said that the government should make rules by February 28, 2023 and after that conduct physical and written examinations.
