Government not in favor of 'Creamy layer' apply to SCs/STs

On Monday, the Central Government said in the Supreme Court that it was not in favor of the creamy layer system in the SC / ST reservation. The government said that the principle of the creamy layer does not apply in SC, ST reservation. The government also requested to send last year's decision of the top court in this case to a large bench of seven judges for reconsideration.

According to media reports, on Monday, this demand from the Central Government was made by Attorney General KK Venugopal before a three-member bench headed by Chief Justice SA Bobde during the hearing on the petition filed by the Samata Movement Committee. The committee has demanded the creamy layer be removed from the SC, ST reservation.

In the case of reservation, Venugopal demanded to send the issue of applying the principle of creamy layer in the promotion to SC, ST to the larger bench, while advocate Gopal Shankar Narayan appearing on behalf of the petitioner committee said that SC, ST reservation should be excluded from the creamy layer. The issue of doing it was first sent to the Constitution Bench and a decision has been taken twice. In the M. Nagaraj case and then in the last year in the case of Jarnail Singh, the Constitution bench of five judges has said to exclude the creamy layer from a reservation in promotion to SC ST. On this, the Attorney General said that the decision given in the case of Jarnail Singh should be sent to seven judges for reconsideration. After hearing the arguments of both the sides, the bench said to consider the matter after two weeks.
