New Delhi: Since former Union Minister and Congress veteran P Chidambaram was sent to Tihar Jail, questions have been raised as to how the prisoners are kept in the jail? What facilities do they get? How are prisoners treated? What are the rights of inmates in jail? In this regard, the Supreme Court lawyer Upendra Mishra said that Prisons Act-1894 and Model Prisons Manual have been made for the jail administration and the rights and duties of prisoners.

He said that apart from this, the Delhi Prisons Act 2002 has also been made to operate the jails of Delhi. In these, provisions have been made to provide adequate facilities to the inmates of the jail and to protect their rights. Advocate Mishra has stated that according to the Model Prisons Manual, under trial prisoners are given more rights than those convicted in a crime. He said that fundamental rights have also been given to the prisoners in the constitution of the country. Being a prisoner does not necessarily mean that all their fundamental rights have ended.

Advocate Mishra of the apex court says that no prisoner can be denied his fundamental rights without the procedure established by law. The law does not allow mistreatment or inhuman treatment of a prisoner or for cruelty. If the fundamental rights of an inmate are violated in the jail, he can approach the Supreme Court directly under Article 32 and the High Court directly under Article 226. He said that inmates are also given fresh food and employment and they are also paid for the work done by them.
