The High Court of the Indian state of Haryana has questioned the decision of the Additional District and Sessions Judge of Bhiwani and has also summoned the answer. The High Court said that the two main accused of cheating were granted bail, but the anticipatory bail petition of the one whose name is not in the FIR was rejected. Justice Arvind Singh Sangwan ordered the High Court Registrar to summon the reply from the ADJ as to what is the basis for granting bail to the main accused?

For your information, let us tell you that the High Court gave this order while hearing the demand of anticipatory bail of Mohan Sharma, resident of Bhiwani. Yachi Mohan Sharma told the High Court that Sahil Kokcha and Lakshmi Kokcha had taken a loan of ten lakh rupees from Bhiwani's Shri Ram Finance. Instead, he mortgaged his house to Shri Ram Finance. He paid the loan installment for seven months but stopped paying installment thereafter. A few days later, it was learned that Sahil Kokcha and Lakshmi Kokcha sold the house with the help of fake NOC to a woman named Kirti and changed the MC record.

The original sale deed of the house was with the company. The company registered an FIR against both. The petitioner said that the same Additional District Judge heard his plea along with the two main accused. But those whose names were registered in the FIR were granted bail, while the petitioner, who is a bank employee and whose name is not even in the FIR, dismissed his bail plea. The petitioner is alleged that the NOC was issued by him, while he did not sign any NOC.
