New Delhi: The Supreme Court has said that the benefit of the reservation should not be passed on to the heirs of those 'noble personalities' who have been in the category of the wealthy by taking advantage of reservation for 70 years. Over the years, the benefit of reservation could not reach the needy people of the Scheduled Castes and Scheduled Tribes in the true sense, the court said, the government should remodel the list of Scheduled Castes and Scheduled Tribes.

A five-member Constitution Bench comprising Justice Arun Mishra, Justice Indira Banerjee, Justice Vineet Sharan, Justice MR Shah and Justice Anirudh Bose said that It is not wrong to make changes in the list which was made 70 years ago. The principle of the reservation is to give benefit to the needy. The Constitution Bench said in one of its orders that there is a conflict within the Scheduled Castes, Scheduled Tribes and Backward Classes as to what should be the criteria for eligibility. The bench said it is the responsibility of the government to amend the list as stated by the nine-member bench in Indra Sawhney case.

The constitution bench said that there are socially and economically strong people within the reserved category. There is a struggle for the need to bring the needy people into the social mainstream, even then they are not getting the real benefit of reservation. Voices are raising about this.
