SC refused to hear plea demanding school fees waiver in corona crisis

New Delhi: The Supreme Court on Friday refused to hear a petition directing the government to waive fees for three months in private schools across the country in view of the lockdown applicable across the country due to the corona epidemic. The court directed the petitioners to take their complaint before the High Courts of the respective states.

A division bench of Chief Justice Sharad Arvid Bobde, Justice R Subhash Reddy and Justice AS Bopanna refused to hear the petition of Sushil Sharma and others, saying that the issue related to school fees should be placed before the High Courts of the respective states. The petition was filed in the Supreme Court on behalf of the parent associations of Delhi, Maharashtra, Uttarakhand, Haryana, Gujarat, Punjab, Odisha, Rajasthan and Madhya Pradesh. The petition urged the court to order for April, May and June fee waivers and to develop a system to control the structure and collection of fees during the lockdown period throughout the country.

During the hearing, CJI Bobde said that the situation is different for each state. The petitioners have filed this petition for schools across the country. CJI Bobde said, "It is our problem that who will decide in a lump sum for all the schools in the country." Every state has different problems. The parties consider the jurisdiction of this court as multi-purpose, but the situation is different in every state and every district.
