New Delhi: The Supreme Court will hear today on the petition filed against the formation of a coalition government of Congress, NCP and Shiv Sena in Maharashtra. This petition has been filed by Akhil Bharat Hindu Mahasabha leader Pramod Pandit Joshi, which said that the government formed on the basis of post-election party alliance should be declared unconstitutional. The Shiv Sena fought the elections in alliance with the BJP, but the government is forming with another party which is a fraud with the voters.

The hearing of this case will be done by the same bench of judges, who had heard about the floor test in Maharashtra. Earlier, the apex court had ordered a floor test in Maharashtra. The top court had said that the governor should appoint a pro tem speaker. MLAs should be sworn in till 5 pm on Wednesday. Immediately after this, there is a majority test. There should be no secret ballot and live telecast of proceedings. However, after the resignation of Ajit Pawar and then Devendra Fadnavis, there was no need for a floor test.

The apex court had said that the court does not interfere in parliamentary traditions, but is giving orders to protect democratic values. Justice Ramna had said that there has been a long debate on the authority of the court and the legislature. Democratic values must be protected and the public has the right to better governance. This case has raised a very important constitutional issue regarding the powers of the Governor. The court had also referred to the cases of Karnataka and Uttarakhand in its judgment.
