Health Ministry proposes imprisonment up to ten years for attacking doctors

New Delhi: Concerned over the incidents of assault with doctors and nurses, the government is now preparing to enact a new law regarding this. According to the new law, an incident of assault with a doctor, nurse and any employee-related to healthcare will be considered a serious offense and will be non-bailable. The Union Health Ministry has drafted a new law and suggestions and objections have been sought from the people. It's draft name is The Healthcare Service Personal and Clinical Establishment (Prohibition of Violence and Damage to Property) Bill 2019.

Under the new law, doctors who practice personally are also protected. Beating with doctors, nurses or any kind of staff related to healthcare will fall in the category of serious crime and it will be a non-bailable offense. In the new law, the use of abusive words with doctors, nurses and health workers will also come under the category of serious crime. Under the new law, a person involved in any such type of crime along with the health worker has a punishment of at least six months to 5 years and a fine will also be imposed.

The amount of the fine will be at least 50 thousand and maximum of 5 lakhs, while such violence with healthcare staff which comes under the Indian Penal Code 320, in such cases the punishment of minimum 3 years and maximum of 10 years in the new law. There will be a provision and fine of 2 lakh to 10 lakh can be investigated in such cases only by an officer of the rank of Deputy Superintendent of Police or above.
