What is the Definition of Minority? Supreme Court Seeks Suggestions From Attorney General

NEW DELHI: Hearing a petition seeking a new definition of the minority in the country, the supreme court has asked the petitioner to give a copy of the petition to the Attorney General. The Supreme Court has also sought suggestions from the Attorney General in the case, which will now be heard after four weeks. The petition was filed by BJP leader and lawyer Ashwani Kumar Upadhyay.

The petitioner had submitted a memorandum to the Minority Commission on November 17, 2017 and demanded that the 1993 notification declaring five communities as minorities be dismissed. It also sought to determine the definition and identity of the minority as well as to declare Hindus as minorities in areas where the number of Hindus is very low. The apex court had asked the commission to take a decision on the memorandum within 3 months.

Upadhyay had filed a petition in the Supreme Court seeking the court to determine the definition and identity of the minority. Under Articles 29 and 30 of the Constitution of India, there is a separate provision for those who are considered to be minorities on the basis of language and religion. But because of the lack of accurate interpretation and definition of 'minority', it is being misused on a large scale.
