New Delhi: The Delhi High Court on Friday refused to allow an unmarried 23-week pregnant woman to undergo an abortion. The court has said in two words that it is actually tantamount to foeticide. A bench of Chief Justice Satish Chandra Sharma and Justice Subrahmanyam Prasad, while hearing a plea by the woman seeking permission for abortion, suggested that the petitioner be kept somewhere safe till the child is given birth and the child can be adopted thereafter.

The court said that we will ensure that the girl child is kept somewhere safe and she can give birth in a safe manner and leave her for adoption. There are many people out for adoption. The Court observed that of the total pregnancy of 36 weeks, about 24 weeks have been completed. The court said that we will not allow you to kill the child. We are sorry. It would actually be tantamount to killing a fetus. The counsel appearing for the petitioner submitted that the woman being unmarried was in a lot of mental agonies and she was not in a position to bring up the child. The lawyer also told the court that the law prohibiting unmarried women from having abortions is discriminatory.

To this, the high court said that it was not forcing the petitioner to raise the child and asked the lawyer to give his opinion on his suggestions after lunch. The court said that we are not forcing her to raise the child. We will ensure that their delivery is in a good hospital. No one will be given any information about you. Give birth to the baby.
