December 16 gangrape is still waiting for justice as Two death row offenders file review plea in SC

Two of the four death row offenders in the December 16, 2012, gangrape and murder case today approached the Supreme Court for review of its judgment as they were given the capital punishment.

The review petition by offender Vinay Sharma and Pawan Kumar Gupta came after the Supreme Court on December 12 completed the hearing on the review plea lodged by another death row offender Mukesh.

A paramedic, a 23-year-old student was gang-raped on the intervening night of December 16-17, 2012 inside a moving bus in South Delhi by a gang of six persons and harshly assaulted ahead of being thrown out naked.

The review plea, lodged by advocate AP Singh for two of the offenders, claimed that death penalty was an intended and cold blooded killing of a human being by the state in the name of justice.

It said the inquiry in the matter was not only flawed but also erratic as many facts of the inquiry be relevant to recording of the dying announcement of the sufferer.

The top court had on December 12 permitted the counsel to file review petition for another offender Akshay Singh and listed the matter for hearing on January 22.

The top court had on May 5 sentenced the death penalty to the four offenders - Mukesh (29), Pawan (22), Vinay Sharma (23) and Akshay Kumar Singh (31), stating the "brutal, barbaric and diabolic nature" of the crime could create a "tsunami of shock" to destroy a civilized society.
