'Go to HC...', SC refuses to hear the pain of trembling Joshimath

New Delhi: Even after the High Court's order in Haldwani, Uttarakhand, the Supreme Court, which immediately stayed action against the encroachment, has now refused to listen to the pleas of the victims of Joshimath in the same state. Let us tell you that due to land subsidence in Joshimath, huge cracks have appeared in many houses, and a request was made in the apex court for help regarding this tragedy. 

On this petition, the apex court heard today i.e. Monday (January 16), and said that if such a matter is already going on in the High Court, then it has to be seen whether its hearing is necessary or not. While making this remark, the court has asked the petitioner to approach the High Court as he can get relief from there also. Swami Avimukteshwaranand Saraswati had filed a public interest litigation in the Supreme Court to save Joshimath and demanded an immediate hearing. In this, a request was made to declare Joshimath a national disaster and provide financial help to the affected. But, on January 10, the Supreme Court declined an urgent hearing of the petition, saying there was no need to bring everything to the court. Democratically elected bodies are there to see it. 

Today, on Monday (January 16), the matter was heard in the apex court after lunch. However, the Supreme Court sought an answer from the Uttarakhand government as to what is the situation in Joshimath. On this, the Uttarakhand government has informed that a similar petition has also been filed in the Nainital High Court. Also, a similar petition has been filed in the Delhi High Court. The State Government said that the Central and State Governments are keeping a close watch on this tragedy.

After which the bench headed by Chief Justice (CJI) DY Chandrachud said that if this petition is already being heard in the Uttarakhand High Court, then it has to be seen whether there is any point in hearing here or not. Making this comment, the Supreme Court has asked the petitioner to approach the High Court. The Supreme Court said that the High Court also has powers to provide relief in this matter. It may be mentioned that in Haldwani of the same state, a case of encroachment on several acres of railway land had also come to the fore, on which after a long hearing, the High Court had ordered the government to remove the encroachment. But, even before the bulldozers could reach to remove the encroachment, the Supreme Court immediately stayed the High Court order.
