New Delhi: You may have read the supreme court's order on Friday (February 18, 2022) to refund the amount recovered from the protesters who protested in December 2019 against the Citizenship Amendment Act (CAA) brought by the Central government, but what has been reported in the media reports is not entirely true. This is because the Supreme Court has asked the Yogi government to recover from CAA rioters, but under the 'Uttar Pradesh Recovery of Damage to Public and Private Property Act, 2020 act.'

 

On this, Kanchan Gupta, advisor in the Ministry of Information and Broadcasting, Government of India, tweeted that there is wrong reporting of withdrawal of the notice issued by the Uttar Pradesh government to the ANTI-CAA opponents causing damage to government property. The supreme court has said that the damages should be recovered but under the 2020 law.'' According to Kanchan Gupta, "The UP government will now again issue notices to the rioters of CAA under the 2020 Act and provide for the tribunal punishment established under the 2020 law."

 

Kanchan Gupta further wrote, "Those who are happy and celebrating that the apex court has stayed the punishment for CAA opponents, should not order biryani for now. Kanchan Gupta said that now the Uttar Pradesh government is free to go ahead under the 2020 Act.'' Let us tell you that, all the media channels had made their news only half the truth of the court's order, while the court has not stopped the UP government from making the recovery, but has instructed to take action under a certain law.

The matter was heard by a bench headed by Justice DY Chandrachud of the Supreme Court. Justice Surya Kant was also involved. During the hearing, the supreme court made it clear that the UP government can issue a fresh notice for recovery or action under the 'Uttar Pradesh Recovery of Damage to Public and Private Property Act, 2020.' During the hearing, Garima Prasad, Additional Advocate General by the UP government, said that the protesters and the government should be allowed to approach the Claim Tribunal. At the same time, he also opposed the order to return the money recovered from the top court. However, the Supreme Court refused to accept him.
