SC gives a major verdict on SC-ST Act, withdraws its old order

New Delhi: The Supreme Court on Tuesday withdrew the Supreme Court's decision of March 20, 2018 to soften the provisions of arrest under the Scheduled Castes and Tribes (Protection from Atrocities) Act, now FIRs can be filed without investigation. A bench of Justices Arun Mishra, Justice MR Shah and Justice BR Gavai gave the order on a review petition of the Central Government.

The court said that the struggle of Scheduled Castes and Tribes for equality has not yet ended in the country. The court said that SC-ST people in the society are still facing untouchability and indecency and are forced to live ostracized. The apex court said that people belonging to the SC-ST category are protected under Article 15 of the Constitution, but in spite of this they are being sided with.

On the issue of misuse of the provisions of this law and the filing of false cases, the apex court said that it is not a result of caste system but a result of human failure. Let us tell you that the Supreme Court, while hearing the case on January 30, refused to stay the amendments in the SC-ST law. The central government changed the decision of the Supreme Court bypassing the Scheduled Castes Scheduled Tribes (Prevention of Atrocities) Act, 2018 in Parliament after the apex court verdict created a ruckus in the country.
