Supreme Court's opinion on increasing the age of marriage of girls

New Delhi: Different arguments are being made in the country to increase the age of marriage of girls from 18 to 21 as boys. Some people are praising the government's decision, while some find it an unnecessary step. However, there are now reports that the Central government's decision to increase the marriage age of girls came after the Supreme Court's verdict in 2017 questioning the rape law.

The apex court had in October 2017 while hearing a case of exemption from marital rape. At that time, by its order, the court had eliminated the unnecessary distinction between a married minor and an unmarried minor. In its order, the Supreme Court had said that no law can be narrow and stable. The law should be changed according to the needs of society. In view of the same observation of the Hon'ble Court, the Government has decided to increase the minimum age of marriage.

According to media reports, a source close to the case said that in view of the apex court order, legal experts in the government advised to increase the valid age of marriage of girls from 18 to 21 years. Interestingly, in August 2018, the Law Commission had also advised that the minimum age of marriage for men and women alike should be 18 years.
