Now the Supreme Court will prepare a detailed guideline for the death penalty

New Delhi: The Supreme Court is now going to prepare a detailed guideline for the death penalty in the courts of the whole country. The court has taken suo motu cognizance of this serious issue. A bench of Justice Uday Umesh Lalit, Justice S Ravindra Bhatt and Justice PS Narasimha was hearing the petition of death row convict Irfan alias Bhayu Mewati, challenging the death penalty.

During the hearing, Parameshwara of Amicus Cure Senior Advocate said that in many states, promotion is given to the Public Prosecutor on the basis of how many criminals he got punished in many cases, that too the death penalty. After this the court took cognizance of it. The trial court fixed the death penalty for Irfan and the Madhya Pradesh High Court has also upheld this decision. The three-judge bench, during the ongoing hearing on this petition, said that the guideline is necessary to fix the harshest punishment in the offenses deserving of death penalty. The court will prepare it soon.

The division bench has also sought the help of Attorney General KK Venugopal in this regard. Along with this, a notice has also been sent to the National Legal Services Authority (NALSA). The Supreme Court said that now the time has come that the rules should also be made regarding deciding the death penalty, that is, it should be institutionalized, because the convict who is sentenced to this punishment has very little means to defend himself.
